GENERAL CONDITIONS

The general conditions of the contract here presented regulate the terms and conditions applicable to the contract stipulated for the apartment chosen by the Client between those presented in www.apartofparis.com. The Client authorizes expressly the A part of Paris to use means of communication (such as fax and email) for the writing out and the carrying out of the contract. Regulations of reference are those of French and European system, and the legal person stipulating the contract is subject to French and European regulations.

1) BOOKING & CONTRACT

 

A)    Selecting a Property:  the Client may request information regarding the availability and price of the selected property by sending an email or by the Reservation Request Form which is available in www.apartofparis.com.

B)   Reservation Process: Should the Client accept the proposal of A part of Paris, A part of Paris will request the full address & phone number of the Client in order to establish and send the Rental Agreement by email. The Rental Agreement will stipulate the full rent as well as any additional costs (late check-in, check-in on Sundays, bank holidays etc) and the amount of the refundable security deposit.

For acceptance, the Client shall fill in all missing data, sign the Rental Agreement and send it to A part of Paris by postal mail or by email. The booking will be confirmed after the first payment of 50% of total rate (weekly rentals) and agency fee & first month rent (monthly rentals) within 24 hours from reception of the Rental Agreement. Should the payment arrive out of the terms, A part of Paris will be free to accept it or to submit the Client a new proposal. By submitting the down payment for a reservation, the client accepts the general conditions of A part of Paris.

2) PRICE & PAYMENT

 

A)    The rental price on the Rental Agreement is the price for the full rental period. Weekly rates include energy and utility costs, taxes and fees except any fee mentioned on the Rental Agreement. Monthly rates do not include energy and utility costs. Final departure cleaning is not included in the rental rates. Supplements for late check-in and check-in on Sundays/bank holidays are stipulated on the Rental Agreement. Supplements for specific periods (Christmas, New Year etc) will be indicated at reservation.

The down payment of the rental price shall be paid at the moment of reservation (within 24 hours from reception of the Rental Agreement) by credit card or by bank transfer. The balance should be paid before arrival ) by credit card or by bank transfer or latest upon arrival to the apartment by credit card or by cash. It is not possible to pay by check except for people residing in France and having a French bank account. The balance of weekly rentals is 50% of the total rent. For monthly rents, there is no balance to be paid.

 

The security deposit should be paid upon arrival to the apartment by cash or by credit card (3).

  

B)   The Client shall pay the rental price and extra or additional costs, if any, in accordance with terms and conditions stipulated in the general conditions. Failing that the service will be refused and not carried out.

 

C)   A part of Paris will charge bank transfer costs when the rental balance is paid by credit card or by cash if these costs have not been taken in charge by the Client. Moreover, the client shall pay a supplement of 2% for any balance paid by credit card.

 

D)   The refund of the security deposit will be carried out through the same mean as the payment has been done (cash or credit card). Any fee incurred for the restitution of the security deposit remains in charge of the client.

 

E)   Special rates and minimum stays might apply for specific periods (Christmas, New Year, fair periods etc)

 

 3) SECURITY DEPOSIT

A)   The amount of the security deposit will be mentioned on the Rental Agreement.

Weekly rentals : 75 - 100 % of total rent. Monthly rentals : 1 - 2 month rent


Some exceptions are foreseen in case of high quality properties, presence of animals, etc.

 

The security deposit shall be refunded in full within 15 working days from the end of the Rental Agreement. However, the A part of Paris has the right to withhold the security deposit in full or in part for 2 months after the departure of the Client for any damage made by the Client or any specific cleaning costs necessary after the departure of the Client.

In case the Client asks to have an unlocked phone on international and mobile numbers, the security deposit could be held for 2 months in order to allow A part of Paris to check the bill and eventually charge the outgoing calls on international numbers and mobile numbers which are not part of the free call list given on arrival.

 

B)   The security deposit is refunded by the same mean the client paid the security deposit unless anything else is decided between A part of Paris and the Client upon arrival to the apartment.

4) FINAL CLEANING

The apartment should be left in the same state and condition as it was at the beginning of the rental including all equipment of the apartment. The client can chose to do the departure cleaning by himself / herself or use the cleaning service of A part of Paris. Should the apartment not meet our cleaning standards at the time of departure, the cleaning cost will be deducted from the security deposit.

Studio : 50 €

1 bedroom : 50 €

2 bedroom : 75 €

3 bedroom : 100 €

5) CHANGE OF DATE, CANCELLATION & REPLACEMENT OF PROPERTY

 

A)   The duration of the rental shall be indicated in the Rental Agreement. Should the Client request a change of the duration of the Rental Agreement, A part of Paris reserves the right to verify the possibility of the request and to charge the Client the sum of 100.00 euro for the changing of the Rental Agreement.

 

B)   Should the notice of Booking Cancellation be given more than 60 days before the beginning of the rental period, A part of Paris will refund the down payment made at the moment of reservation deducting a sum of 200 euros.

 

C)   Should the notice of Booking Cancellation be given 60 or less than 60 days before the beginning of the rental period, A part of Paris will have the right to withhold the down payment made at the moment of reservation.

 

D)   Should the notice of Booking Cancellation be given 48 hours or less than 48 hours before the beginning of the rental period, A part of Paris will have the right to withhold or claim the full rental price.

 

E)   A part of Paris reserves the right to replace the property with another property of the same or greater quality, if A part of Paris should be not in position to provide the property reserved by the Client, because of force majeure or for any reason not depending of A part of Paris. Should the Client refuse the property offered as replacement because of reasonable a proven justifications, A part of Paris shall refund all the sums paid by the Client. No further sum shall be due to the Client for any reason.

  

6) ADDITIONAL SERVICES

A part of Paris offers additional services from partner companies. A part of Paris bears no responsibility in case of disputes between the two parties. Transfer service, insurances

 

7) INSURANCE

 

The Client needs to be covered by a multi-risk rental insurance for any damage caused during the stay.
A part of Paris cooperates with Cabinet Albinet offering short & long term rental insurances including personal liability, damage, cancellation and curtailment.
A part of Paris bears no responsibility in case of disputes between the Client and the insurance company.

 

8) ARRIVAL & DEPARTURE

A)   The keys of the property will be delivered to the Client by a person in charge from A part of Paris. Clients will need to communicate the following information to A part of Paris before the arrival date :

·         Airport, train station or arrival by car       

·         Arrival time to the airport & flight number, arrival time to the train station or arrival time by car

·         Mobil telephone number the Client could be reached

 

The Client need to call the telephone number indicated by A part of Paris in order to confirm his/her arrival. The final check-in time will then be set. A part of Paris is not responsible for any delaid check-in if the arrival procedure is not respected by the client.

B)   Arrivals from Monday to Saturday between 9.00 and 18.00 are free of charge. Any arrival beyond these days and this time frame shall be subject to an extra fee mentioned on the Rental Agreement

C)   The check-in time is fixed at 14.00. However, the client can send a request of early check-in. A part of Paris is not obliged to accept any check-in before 14.00 whatever the circumstance.

 

D)   The check-out time is fixed at 10.00. However, the client can send a request of late check-out. A part of Paris is not obliged to accept any later check-out whatever the circumstance. Any check out beyond 10.00 without any preliminary request and acceptation shall be subject to an extra fee to be charged to the security deposit.

 

E)   Upon departure, the Client should leave the keys in the apartment and close the door unless any other instruction has been given upon arrival. The Client undertakes to redeliver the keys of the apartment in accordance with the instructions received by A part of Paris.

For any monthly rental a check-out appointment must be organized between A part of Paris and the Client.

 

9) CLIENTS OBLIGATIONS

 

A)   The Client undertakes to not host a greater number of people than mentioned in the Rental Agreement. If the Client does not respect the maximum capacity of the apartment, the Client will be obliged to leave the property immediately. It will be applied a penalty of 30% of the rental price for each person exceeding the number of persons mentioned in the Rental Agreement.

 

B)   The Client should not damage or injure the property or make any alteration in or addition to it. The Client should preserve the furniture, the equipement and the effects for being destroyed or damaged and not remove any of them from the property. The owner should immediately be informed about any damage to the property. The renter is responsible for damage by a third party invited to the apartment during the rental.

 

C)   Unless otherwise instructed it is absolutely forbidden to smoke in any apartment.

 

D)   The Client undertakes to use the property without disturbing the resident nearby the building. It is absolutely forbidden to use the property for immoral and unlawful acts.

 

E)   The Client undertakes not to make copies and not to deliver the keys to third parties and/or not to divulge any access code to third parties. The loss and/or damage of the keys and/or lock shall be indemnified by the Client for the full cost of a new lock and 5 sets of new keys.

 

F)   The Client also agrees to take reasonable care and adopt the necessary safety measures to avoid unauthorized persons from accessing the apartment for the entire duration of Rental Agreement. In the case of failure to comply with the said obligation, the Client shall be liable to the A part of Paris for any damage caused to the apartment and/or items contained therein.

 

10 ) RIGHT OF ACCES TO THE APARTMENT

 

A part of Paris and/or any third parties appointed by A part of Paris, identifiable upon request by the Client, shall have access to the apartment to carry out any necessary repair and/or maintenance work. The Client will receive prior notice thereof, except in the case of an emergency.

11) PETS

             

Unless expressly authorized in writing by A part of Paris, the Client shall not be allowed to have pets of any kind in the apartment.

 

12) SUSPENSION OF UTILITIES

 

A part of Paris will not be liable to the Client for any suspensions or interruptions of the electricity and/or gas and/or water supply for reasons beyond its control. A part of Paris will not be liable to the Client for any temporary interruption and/or technical problem with the internet / television / telephone supply or any other equipment of the apartment.

 

13 )  EXPRESS TERMINATION CLAUSE

 

A part of Paris may terminate the Rental Agreement in accordance with French law by sending the Client written notice via fax, in any of the following events:

 

      • Should the Client fail to pay the balance or the rent in accordance with the terms set in the Rental Agreement or
      • Should the Client fail to pay the security deposit set in the Rental Agreement or should the Client\'s conduct be contrary to taking care of the property (see art. 9) or
      • Should the client failed to pay the extra fee incurred due to late check-in and/or check-in on Sundays and public holidays (see art. 8)
